AIM Infotech
Terms & Conditions
Last updated: October 30, 2026
These Terms & Conditions ("Terms") govern your use of aiminfotech.ca (the "Website") and the general terms on which AIM Infotech ("we", "us") provides services to clients ("you"). A signed proposal, quote or service agreement for a specific project forms part of these Terms; if it conflicts with these Terms, the signed document prevails.
1. Using the Website
- You may use the Website for lawful purposes and to learn about or contact us about our services.
- You must not attempt to interfere with the Website's security, submit spam or malicious code, scrape it in a way that harms performance, or misuse our forms.
- Website content is provided for general information; see our Disclaimer.
- Our handling of personal information is described in our Privacy Policy.
2. Services and packages
We offer website design and development, mobile app development, SEO and digital marketing, e-commerce development, cloud and IT support and business automation. Package prices shown on our Pricing page (for example, Starter, Business and E-Commerce website packages, available as one-time builds or monthly plans) are starting prices for the scope described. The final price, deliverables and timeline for your project are set out in your written quote or proposal.
3. Quotes and acceptance
Quotes are valid for 30 days unless stated otherwise. A project starts when you accept the quote in writing (including by email or e-signature) and any required deposit is received.
4. Fees and payment
- All prices are in Canadian dollars (CAD) and exclude applicable taxes such as GST, which are added to invoices.
- One-time projects: a deposit of 50% is due before work begins, with the balance due before launch.
- Monthly plans: billed in advance each month, with a minimum term of 12 months. You may cancel with 30 days' written notice; if you leave before the minimum term ends, the remaining project balance (the one-time build cost not yet paid through the plan) becomes due.
- Invoices are due within 14 days. We may pause work or services on overdue accounts and may charge interest on overdue amounts as stated in your quote, where permitted by law.
- Third-party costs (such as hosting, domains, software licences, premium plugins, stock images, app store fees, advertising spend or software licences) are your responsibility unless your quote says they are included.
5. Project scope and revisions
- We deliver the work described in the agreed scope. Each package includes 2 rounds of design revisions at the stated milestones.
- Requests outside the agreed scope, or extra revision rounds, are change requests. We will confirm the cost and timing impact in writing before doing the work.
- Timelines depend on you providing content, feedback, access and approvals promptly. If a project is inactive because we are waiting on you for more than 60 days, we may close or reschedule it and invoice for work completed.
6. Your responsibilities
- You confirm that you own or have permission to use all content, logos, images and data you provide, and that it is lawful.
- You are responsible for reviewing and approving content before launch, including legal, pricing and regulatory statements about your business.
- You will keep any logins we provide secure.
7. Intellectual property
- On full payment of all amounts due for a project, ownership of the final custom deliverables created specifically for you (such as your website design, custom code and written content) transfers to you.
- Until full payment, we retain ownership and grant you a limited licence to review the work.
- Third-party components (open-source software, themes, plugins, fonts, stock media) remain subject to their own licences.
- We keep ownership of our pre-existing tools, frameworks and know-how and grant you a perpetual licence to use them as part of your deliverables.
- For monthly plans, ownership of the website transfers to you once any outstanding project balance is paid; we will transfer hosting and your domain on request.
- We may show completed work in our portfolio unless you opt out in writing, and we never disclose confidential information.
8. Confidentiality
Each party will keep the other's non-public business information confidential and use it only for the project, except where disclosure is required by law.
9. Hosting, maintenance and third-party services
Where we provide hosting or maintenance, we use reasonable efforts to keep services available and secure, but we do not guarantee uninterrupted service. We are not responsible for outages or changes by third-party providers such as hosting companies, payment gateways, app stores or search engines.
10. No guaranteed results
SEO, advertising and marketing outcomes depend on factors outside our control, including search engine algorithms and competition. We do not guarantee specific rankings, traffic, leads or revenue.
11. Warranties and limitation of liability
- We will perform services with reasonable skill and care. We will fix defects in our own work reported within 30 days of launch at no charge.
- Except as stated in these Terms, the Website and services are provided "as is" to the extent permitted by law.
- To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential losses, including lost profits, data or business opportunities.
- Our total liability for any claim relating to a project is limited to the fees you paid us for that project.
- Nothing in these Terms limits liability that cannot be limited by law.
12. Indemnity
You agree to indemnify us against claims arising from content or materials you supplied, or from your breach of these Terms.
13. Cancellation and termination
Either party may end a project or plan as described in our Refund & Cancellation Policy. On termination you pay for work completed and costs incurred to that date.
14. Governing law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. The courts of Alberta, sitting in Edmonton, have jurisdiction over any dispute. We will first try to resolve disagreements in good faith by discussion.
15. Changes
We may update these Terms. Changes apply to new projects and to use of the Website after the update; signed agreements continue on their agreed terms.
